For more complete and more current information with regard to the Peanut Butter of America peanut butter salmonella outbreak, please see our "California Salmonella Outbreak Lawyers" page which you can find by putting your cursor over "Food Poisoning Lawyers" in our List of Practice Areas, on the top left aspect of this page. The following article, written by our salmonella lawyers, for a number of news publications, only briefly summarizes the information which our attorneys had compiled as of late January 2009, still at the very early stages of the FDA and CDC investigation into the Peanut Corporation of America peanut butter salmonella outbreak.

Salmonella Lawyers Gear Up for Peanut Butter Samonellosis Outbreak Litigation

As the FDA and Attorney General are gearing up for the criminal investigation of Peanut Corporation of America, so are our California salmonella lawyers gearing up to assure that those who have suffered serious illness and those who have lost a loved one due to the peanut butter salmonella outbreak will receive just compensation.

While the newspapers have carried stories that a few over 600 have suffered serious illness and that 8 have died from peanut butter products, including crackers, cookies, energy bars and even ice cream contaminated by salmonella, our salmonella attorneys have stated that "this is only the tip of the iceberg" in terms of the true numbers of those who have suffered salmonellosis directly caused by the unsanitary conditions at the Peanut Cororpation of America Blakely Georgia and Plainview Texas plants. The reason is in part because most cases will not be reported, either because the food poisoned individual may not seek medical attention, or may be inadequately diagnosed, or the physician may fail to report the case. For more information generally about the salmonella outbreak you may consider our "Salmonella Lawyers Peanut Corporation of America" main page. You may also choose to learn more on this site about the "Probable Causes for the Salmonella Contamination at the Peanut Corporation of America Plants," at which our California salmonella lawyers review the serious sanitation issues at the PCA Blakely Georgia plant, including large holes in the celing permitting entry of bird excrement and rain water, as well has holes in the perimeter large enough to permit rat infestation; similar issues found to exist at the Peanut Corporation of America Plainview Plant, the Texas Department of Health finding dead rats and rodent feces in proximity to air ducts ventilating the production areas. You may also review here "Our Salmonella Lawyers Position on Peanut Corporation of America's Liability for Negligence, Intentional Conduct and Fraud," based in part on an FDA report that Peanut Corporation of America sold its product into commerce with full knowledge that it was salmonella contaminated, failed to destroy product testing positive for salmonella, would obtain second tests from different laboratories to justify selling the product, at least once distributing the product with a "homemade" document attesting to its purity. We also discuss "Peanut Corporation of America's Bankruptcy, and Why Our Salmonella Food Poisoning Lawyers Consider that Compensation Will Be Recovered by Those Suffering Illness." In order for our readers to guage the bredth of the contamination of food products, our salmonella attorneys also provide a "Peanut Corporation of America Salmonella Contaminated Product Recall List" of more that 2000 products, already representing the largest food product recall in the history of the United States.

"There is a salmonella problem at the plant," said Robert Tauxe, deputy director of the CDC's division of food-borne, bacterial and mycotic diseases. Federal investigators have said that PCA knowingly shipped its contaminated peanut butter. According to the information thus far discovered by our salmonella lawyers as of this still early date in the investigation, the PCA Blakely Georgia plant itself had identified Salmonella bacteria in its peanut butter paste at least a dozen times in 2007 and 2008. But it failed to correct the sanitation issues that resulted in the presence of the bacteria, and it continued to ship the product in interstate commerce. The plant also stored pallets of its peanut better next to raw supplies of peanuts despite that proper controls would have required the company to store its finished product at a distance from its raw material to avoid recontamination. "Open gaps observed” according to the federal investigation, including gaps as large as a half inch by two and one half feet long near air-conditioner intakes. Also found was rust residue that could flake into food, as well as gaps in the warehouse doors that were large enough for rodents to enter the plant. At the Plainview Texas plant similar issues existed with rainwater bearing bird excrement entering the production area from the roof, dead rats and rodent excrement found next to the air intake ventilating the production area. Given the most common and known sources of salmonella contamination, our California salmonella food poisoning lawyers speculate that it is probable that rodent feces or possibly bird feces was responsible for the contamination leading to the outbreak. Salmonella is carried by animal feces, but foods can also become contaminated by infected food handlers who may not properly wash their hands after using the restroom.

In terms of the liability of PCA for the outbreak, our California salmonella lawyers consider that there is already overwhelming evidence of the company's negligence, and it appears that there is good initial evidence that the company knowingly sold its contaminated peanut butter paste to a variety of companies without regard to the serious illness and death that was likely to occur, particularly to infants, young children, the elderly and the immune compromised. Our salmonella attorneys want to see the actual data, but early estimates are that children under 5 years of age account for between one fifth to one half of all those thus far identified as suffering serious illness from PCA salmonellosis outbreak.
